A decision by the D.C. Circuit Court of Appeals on May 23 nullified a FERC order (745) dealing with the payment of demand response resources in wholesale energy markets (Order 745). Order 745 required that when grid operators determine that demand response is cost-effective, DR resources must be compensated for the service they provide to the energy market at the market price for energy. In a split decision by a three-judge panel, the court ruled that with this order FERC had gone too far, encroaching on the jurisdiction of states on retail electricity markets.

Also, EPA recently released its draft proposal to regulate carbon emissions from existing power plants under Section 111(d) of the Clean Air Act. The regulations propose state-by-state goals for emissions reductions to be accomplished by 2030, and discuss a variety of options states can take to meet these goals, such as increasing power plant efficiency, switching from coal to natural gas, increasing renewable energy usage, and increasing end-use energy efficiency. Demand response and smart grid are not discussed in the draft regulations.
